The 4 years old boy, Demetrius, accidentally killed himself with .40 Glock and his mom Tiara Danielle Jefferson has been charged for child neglect for the incident.
Jefferson claimed that the gun was a family heirloom, but it was later discovered to have been stolen.
In Jefferson first statement with the police she claimed not to have heard the gunshot because of the drug she used but later gave another statement indicating she may have heard gun go off after her son was left unattended for 3 hours.
Prosecutors said Jefferson's conflicting interview with police and her statement led to the aggravated punishment.
