What Is The Punishment For Escaping Prison In Nigeria?

On the 5th of July 2022, a group of armed men attacked the Kuje correctional facility in Abuja and according to the report on Premium Times, hundreds of prisoners escaped the facility after the attack.

The Kuje Prison attack became the latest of such prison attacks in Nigeria. Clearly, it was not the first time such an attack would take place against a correctional facility in Nigeria. We have seen such attacks in Lagos, Imo, Edo and even Kogi state among others.

But the important question in this article is, is there ever any punishment for prisoners who escape correctional facilities in Nigeria? Yes, there is a punishment for prisoners who prove too smart to escape correctional facilities in the country.

A quick check into the Nigeria constitution shows that there is a punishment for such culprits. According to the Section 135 of the criminal code Act of Nigeria, anyone who escapes from prison is liable to imprisonment for two years if found guilty if such act.

Similar punishment is contained in Section 31 of the Nigerian correctional service act and 173 of the penal code.

Clearly as presented in the Nigerian constitution it is a crime to escape from prison as it may earn such prisoner more prison terms. No prisoner should be encouraged to escape from prison, no matter how obvious the opportunity appears.

In my opinion, when prisoners escape from prison, they have directly passed a message to the authorities that they may never stay away from crimes even if they are later released from such facilities.

Aside the fact that escaping from prison is a criminal act, it is equally useless because such inmates will be on the run for as long as they are recaptured by the authorities. What is the benefit of escaping from prison when such individual cannot live a free life and has to look over his shoulders for security operatives for the rest of the time he is out of prison.
