Just in : Court of Appeal bars Rivers and Lagos States from VAT collection

An Abuja Court of Appeal has stopped Rivers State Government from Value Added Tax(VAT) collection in the state pending the resolution of all legal disputes relating to the matter.

The order was issued by Justice Haruna Simon Tsanami in Abuja on Friday, September 10, 2021. He also gave the directive that the law passed by the House Assembly of Rivers State which was assented to by the Governor of the state, Nyesom Wike, should be put on hold.

According to the Court of Appeal, the parties must not do anything that will destroy the subject matter of the appeal, since they have submitted themselves to the authorities of the court for adjudication of the matter.

The Justice therefore granted status quo ante in favour of Federal Inland Revenue Service (FIRS) and against the respondents, with September 16 being slated for a hearing of the motion seeking that Lagos State be joined in the suit.

Recall that FIRS had earlier approached the appellate court , praying the court to set aside the judgement of a High Court sitting in Rivers State which granted the state the powers to collect VAT.
