According to "PUNCH", An application that the People's Democratic Party and its candidate for president, Atiku Abubakar, had submitted to the Independent National Electoral Commission to compel their agents to participate in the process of sorting out ballot papers for the presidential election on February 25 has been withdrawn.
Both the PDP and Atiku, who are independently difficult the result of the political race that was proclaimed for Bola Tinubu, the competitor of the decision All Moderates Congress, told the Official Political decision Request Council, sitting at the Court of Allure in Abuja, that they have considered it fit to end the application.
When the ex-parte motion was marked: Atiku, through his team of lawyers led by Joe Kyari Gadzama, informed the court that he had submitted a notice of discontinuance when the case CA/PEC/10M/2023 was summoned for a hearing on Wednesday.
The application was then rejected by a three-member panel led by Justice Joseph Ikyegh.
The decision to withdraw the application was made at a meeting his legal team had with the leadership of the electoral body on Tuesday, according to a member of Atiku's legal team who did not wish to be identified.
He stated that the initial filing of the application was motivated by difficulties and administrative bottlenecks they encountered at the INEC office when they sought court-approved access to election materials.
However, INEC called our legal team for a meeting on its own before the application, which was dated March 13, could be scheduled for hearing.
“All of the gray areas were clarified at that meeting that took place yesterday (Tuesday), and INEC promised to let our agents observe the process of sorting out some of the electoral materials we requested, particularly the ballot papers.
“We felt that it would not be necessary to proceed with the hearing because that was primarily our prayer in the fresh application that we filed. We therefore filed a notice of discontinuance, which was consequently granted, to save time in the courtroom.
