Atiku Abubakar and the PDP have withdrawn a fresh application they filed to coerce INEC to allow their agents to partake in the process of sorting out ballot papers that were used during the presidential election. According to information gathered from Vanguard, it will interest you to note that both Atiku and PDP are separately challenging the outcome of the presidential election that declared Bola Tinubu of the APC as the winner of the election.
Joe Kyari Gadzama, SAN, the leader of Atiku's legal team told the court that he had filed a notice of discontinuance when the motion ex-parte that was marked CA/PEC/10M/2023 was called up for hearing on Wednesday. They told the court that they were no longer interested in the application. It should be recalled that after the court granted an order to allow INEC to grant access to the PDP to inspect the election materials used during the presidential election, INEC was reluctant to allow the PDP access to do so.
Atiku's legal team filed an application to the court because of the opposition they encountered at the INEC office when we went for access to the election materials as ordered by the court. Before the day the case would be heard in court, INEC on its own called Atiku's legal team for a meeting and resolve the issue amicably. INEC pledged to allow the agents of the party to observe the process of sorting out some of the electoral materials they requested, especially the ballot papers.
A member of Atiku’s legal team, who preferred anonymity revealed that since that was primarily their prayer in the fresh application they filed, they felt that it would not be necessary to proceed with the hearing. So, to save judicial time, they filed a notice of discontinuance which was accordingly granted.
