The Court of Appeal in Abuja has dismissed a suit by the Independent National Electoral Commission (INEC) seeking to vary the order of the court granting access to Mr Peter Obi and his party, the Labour Party to inspect the Bimodal Voter Accreditation System (BVAS) and other election materials.
The Bimodal Voter Accreditation System (BVAS) equipment and other sensitive items that INEC used for the conduct of the election on February 25th were open for inspection by Obi thanks to permission from the appellate court.
INEC has been forbidden by the court from altering the BVAS devices.
Bola Tinubu's plea to additionally see the electoral materials was approved by the court's three-person panel on Wednesday.
In a unanimous ruling today, the court stated that it was satisfied that Tinubu's request for access to the election records so that he could defend his election victory had merit. The three-member panel was chaired by Justice Joseph Ikyegh.
It was decided that Tinubu and his party had a right to access the materials kept by INEC so that they may examine, scan, and make copies of them.
