4 things to know as Appeal Court set to determine the winner of Cross Rivers North Senatorial Seat

Following the long legal battle surrounding December 5, 2020 Cross River North Senatorial bye-election, the Court of Appeal sitting in Abuja is now set to determine the authentic winner of the election.

As the appellate court set to determine the authentic winner of the election on Thursday August 12, 2021, there are four things the people need to know on the long legal battle between the incumbent Senator, Dr Stephen Odey and Agom Jarigbe.

The Legal Battle Is About The Authentic Candidate of PDP In The Senatorial Election

The long legal tussle is to determine the authentic candidate of the Peoples Democratic Party, PDP, in the December 5, 2020 senatorial bye-election in Cross River North Senatorial District.

While the incumbent Senator, Dr Stephen Odey insisted that he was the authentic candidate of PDP in the Senatorial election, Agom Jarigbe, a House of Representatives member who participated in the election also claimed that he was the authentic candidate of PDP and the winner of the senatorial election. 

The Earlier Judgment of the Tribunal 

The Independent National Electoral Commission, INEC earlier declared Agom Jarigbe as the winner of the Senatorial bye-election and issued a certificate of return to him.

His celebration was short-lived when his political rival, Stephen Odey, approached the National and State Assembly Election Petition Tribunal headed by Justice Yusuf Mohammad and prayed for the court to declare him the winner of the election on the ground that he was the authentic candidate of PDP.

According to a report by Daily Post, the presiding judge of the Tribunal, Justice Yusuf Mohammad, in his ruling ordered INEC to withdraw the Certificate of Return which the electoral umpire earlier issued to Jarigbe and issue same to Stephen Odey as the winner of the senatorial election.

The Tribunal in its ruling on June 18, 2021, further held that Odey was the authentic candidate of PDP in the election. 

Judgment of Calabar Court Of Appeal 

Dissatisfied by the ruling of the Tribunal, Jarigbe approached Court of Appeal, Calabar division and prayed for the court to declare him the authentic candidate of PDP in the senatorial election.  

Jarigbe had argued that the Certificate of Return earlier issued to him by INEC was wrongly withdrawn from him by the Tribunal. He then sought the relief of the appellate court to set aside the judgment of the lower court and declare him the winner of the election.

Remember the Appeal Court sitting in Calabar in its ruling on July 30 held that it was wrong for the Tribunal to withdraw the certificate of return issued to Jarigbe by the INEC. 

The three-man panel of the Calabar division of Appeal Court headed by Justice Chioma Nwosu, sacked Steven Odey after invalidating the Certificate of Return issued to him by INEC and declared Jarigbe Agom as the authentic candidate of PDP. The court also held that Jarigbe was the authentic winner of the December 5, bye-election in Cross River North Senatorial District. 

Court of Appeal In Abuja To Determine The Final Ruling On Thursday

While Jarigbe was preparing to be sworn in as the Senator representing Cross River North Senatorial District, the suit challenging the judgment of Calabar Appeal Court which declared him the winner of the election is now set to be decided on Thursday.

After the Calabar Court of Appeal judgement on July 30, which sacked the incumbent Senator, Steven Odey, the aggrieved parties approached the Abuja Court of appeal and prayed for the court to set aside the ruling of the Calabar Court of Appeal. 

The report by Daily Post also noted that the Court of Appeal sitting in Abuja is set to determine the final ruling on Thursday. Steven Odey, is praying for the court to set aside the earlier judgment of Calabar Court of Appeal while Jarigbe Agom prays for the appellate court to uphold his victory and be sworn in as the Senator representing Cross River North Senatoril District.

Remember that Appeal Court is the last court for National and States House of Assembly election matters, after Thursday judgement there would be no opportunity to appeal the judgment again.
