Zamfara Tussle Gets Tougher As PDP Increases Number Of People It Wants Court To Sack Along With Matawalle

The leadership tussle in Zamfara State has intensified as the opposition Peoples Democratic Party, PDP, has increased the number of persons it wants the court to sack alongside Governor Bello Matawalle.

It would be recalled that Matawalle had months ago defected from PDP to the ruling All Progressives Congress, APC, contrary to PDP's earlier warnings. But, Matawalle did not defect alone, he defected with some federal and state lawmakers and other political office holders loyal to him. Consequently, the PDP deems it wise that it should not ask the court to sack only Matawalle. According to a report by The Punch, PDP increased the number of people it wants the court to sack by adding three Senators, six House of Representatives members, 24 House of Assembly members.

Will the court grant PDP's request?

The answer to the question above is neither here nor there. It depends on how well the PDP pushes its argument and backs them up with evidence. It also depends on which one of the two parties that presents a superior argument to convince the court.

However, there are some solid reasons the PDP is pushing forward that may help it to stand a chance in this case. First, the Governor, Senators and other lawmakers all emerged winners under PDP. It means that the offices in question belong to PDP as a party since Nigeria practices party system (party politics). That is why a candidate must be sponsored by a party before he/she can occupy any political office in the name of the party.

Again, they did not win the posts at the poll. Nigerians can remember that APC had won all the posts at the poll in the 2019 general elections. But, the PDP fought harder through the court and won the case after exploiting the irregularities that marred the APC primary. That was why the Supreme Court declared the PDP winner of all the posts including the post of Governor after nullifying all the victories of the APC in the election. So, PDP candidates then assumed office. How then can they defect to the same APC the court denied victory and expect to retain their offices? The court will decide if this is allowed by law.

Finally, the ground of their defection is another issue. Defection is allowed on two grounds: it is allowed if there are emergence of factions in the party or if the party plans to form a merger with another party. These are the two instances members of a party can defect to another party as allowed by law. But Matawalle and his co-defectors will need to prove to the court that their defection is legal since the PDP argues that none of these two grounds applies to their case.
