The Supreme Court had ruled that it is illegal for Buni to be the acting head of the ruling All Progressives Congress, APC, while at the same time occupying the post of Governor of Yobe State. The Apex Court stated that doing so violates section 183 of the 1999 constitution of Nigeria (as amended).

However, Buni still went ahead to lead his party to hold the congresses earlier scheduled before that judgement by the Supreme Court. Many people have been asking why Buni decided to defy the Apex Court judgment and went ahead to organize the congresses. Well, a report by Daily Trust revealed that the Minister of Justice and Attorney General of the Federation, Abubakar Malami strongly backed Buni's leadership.

Malami during the meeting of top lawyers in the current government of President Muhammadu Buhari which was summoned by Vice President, Yemi Osinbajo, had openly defended Buni. He argued that the ruling of the Supreme Court does not affect Buni as he is holding the post of acting APC head in ad-hoc capacity and not in executive capacity which the constitution is against. With that, it was obvious that Malami strongly backed Buni to carry on as APC head based on the way he interpreted the law in view of the Supreme Court verdict. That could have made Buni to carry on.

New indication reveal another strong group that backed Buni.

Buni also received the backing of another influential group in the APC. The group is made up of most of his fellow APC Governors who strongly supported him to go on with the conduct of the congresses despite the ruling of the Supreme Court. According to a report by The Punch, most of the APC Governors voted voted in support of Buni to carry on with the conduct of the congresses which he eventually did.

Having received the backing of AGF Malami and many APC Governor as well as other party leaders, Buni then went ahead to conduct the APC congresses. That action is still generating controversy as many some people fear that the Supreme Court judgement may invalidate the exercise now or later as opposition parties may take advantage of that.
